Portugal: Gay Marriage Bill Gets Final Approval

The final wording of a gay marriage bill approved by Portugal's Parliament received approval on Wednesday, Portugal's IOL Diario reported. The government's Committee for Constitutional Affairs unanimously agreed on the bill's final language.

The measure now heads to the desk of President Anibal Cavaco Silva. Cavaco Silva is a Roman Catholic and a member of the PSD party, groups which oppose the legalization of gay marriage, and he has publicly stated his opposition to gay marriage.

Opposition to gay marriage in the mostly Roman Catholic country has been nominal, but last Sunday opponents staged a huge rally attended by thousands. A crowd estimated at 5,000 marched down Lisbon's main downtown artery Av. da Liberdade (Liberty Avenue) calling on the president to reject the gay marriage bill and demanding a referendum on gay marriage, although Parliamentarians have already rejected such a measure.

Senator Gillibrand Introduces Bill to De-Fund Don't Ask Don't Tell

A bill that would withhold the cost of implementing the “don't ask, don't tell” policy is expected to be announced tonight by New York Senator Kirsten Gillibrand at a gay fundraiser, the New York Times reported. Gillibrand is the keynote speaker at the Human Rights Campaign's (HRC) ninth annual greater New York fundraiser in Manhattan. HRC, the nation's largest gay rights advocate, recently endorsed Gillibrand's 2010 candidacy.

The bill seeks to deny funding to the military for the costs of implementing the policy that bans gay troops from serving openly in Armed Forces. Gillibrand is expected to introduce her proposal as an amendment to the federal budget.

The policy has come under heavy scrutiny since President Obama called for an end to the law during his first State of the Union address. On Tuesday, the Pentagon's top brass – Admiral Mike Mullen, the chairman of the Joint Chiefs of Staff, and Defense Secretary Robert Gates – told a key Senate panel considering the issue that the military should end the policy.

Albania: Parliament Passes Gay Rights Bill, But Not Gay Marriage

ALBANIA'S new anti-discrimination law defends gays and minorities and meets European standards, its sponsors said on Friday, but warned that homophobia is rife and winning over the public will be slow. Albanian rights groups and the Alliance against the Discrimination of the Lesbian, Gay, Bisexual and Transgender (LGBT) welcomed the law as a powerful legal tool to protect against any kind of discrimination.

Approved by the ruling Democratic Party and its allies in parliament late on Thursday, the law does not allow same-sex marriage as promised by Prime Minister Sali Berisha. Muslim, Orthodox and Catholic communities condemned the idea.

'This law is not simply a fulfilment of requirements that Albania has undertaken for European Union integration and visa liberalisation. Above all, it is a victory for democracy and for human rights for all Albanians,' the LGBT community said. The group hoped that Berisha would eventually keep his promise to legalise same-sex marriage.

MD: Anti Gay Marriage Bill Killed

A key Maryland House committee killed a bill Wednesday that would have prohibited the state from recognizing legal gay marriage performed in other states, according to the Maryland Reporter. Delegate Emmett C. Burns Jr.'s bill died in the House of Delegates Judiciary Committee on a 12 to 8 vote. Burns, a Democrat, is also a Baltimore County Baptist minister.

Two conservative Democrats, Gerron Levi and Kevin Kelly, joined six Republicans in voting in favor of the measure.

Maryland currently restricts marriage to heterosexual unions by law.
Last year, a gay marriage bill never made it out of committee, despite wide support from committee members.

Prop 8 Trial Update, Day 7

It was a phenomenal day in the courtroom, in particular testimony from Ryan Kendall about forced conversion therapy that moved many to tears. We also heard surprising revelations from experts who were supposed to support Prop 8 but whose opinions instead clearly shored up our side. After today, I wish more than ever that the public could be watching the video of this trial - I have truly never seen anything like it. Fortunately, daily transcripts of the trial are now being released with a one day delay and are available on AFER's website. The morning began with an argument over whether the court should allow excerpts to be played from the depositions of two of the defense's expert witnesses, Dr. Paul Nathanson and Dr. Katherine Young. Before trial, each side submitted a list of the witnesses they expected to call, and the Prop 8 proponents said they would call Dr. Nathanson and Dr. Young as experts. Both experts were deposed prior to trial, and their deposition testimony was recorded. Recently, however, the proponents withdrew both witnesses from testifying, suggesting that the experts had requested not to be called due to fears stemming from the proposed broadcasting of the trial. This morning, the plaintiffs asked to play some of those witnesses' testimony, and the Prop 8 proponents objected. Judge Walker allowed the evidence in. It was immediately clear why the Prop 8 proponents had really withdrawn these two expert witnesses -- their testimony strongly supported the plaintiffs' claims, not the defense. Indeed, many in the courtroom appeared to be shocked by how much the defense's experts sounded like they should have been testifying for the plaintiffs. In particular, Dr. Young testified that: (1) homosexuality is a normal variant of human behavior; (2) there have been sub-traditions of allowing marriage between same-sex couples in a number of cultures; (3) allowing same-sex couples to marry enhances their security and well-being and is good for their children; and (4) studies show that there is no harm to children from being raised by gay parents and there is "no reason to predict harm." Dr. Nathanson testified that, in the past, religion has been used to justify discrimination against people based on race and gender in the name of "protecting the family." This testimony from the Prop 8 proponents' own witnesses powerfully refutes the defendants' claims. Full Story from Pam's House Blend

HI: Civil Unions Supporters Rally in Lihue

They have already weather decades of intolerance, so what’s a little wind and rain? About three dozen proponents of gay rights gathered Wednesday afternoon, waving oversize rainbow flags and holding signs with phrases like “What’s wrong with love?” and “Civil Union = Economic Justice” in front of the Historic County Building along Rice Street in Lihu‘e two days before the state Senate gathers for a potentially historic vote in Honolulu. House Bill 444, if it becomes law, would extend the same rights, benefits, protections, and responsibilities of spouses in a marriage to partners in a civil union. “It needs to be viewed more as the government has a responsibility to treat all its citizens equally,” said Kipukai Kuali‘i, one of the event organizers. He said the issue has been “clouded by religious beliefs” and confusion will continue “until we stand up and provide education and provide examples of what the truth is.” Full Story from The Garden Island

UT: New State Senator Supports Gay Rights Bills

New state Sen. Ben McAdams wants to let gay couples and non-traditional families have more rights. Right now, only a parent or spouse can bring a lawsuit in the case of a wrongful death. McAdams wants to let gay couples, unmarried siblings, grandparents, etc., be able to do the same. "In the case of my wife and I, if one of us were to be killed in an accident because of the negligence of another person, the surviving spouse would be able to bring a lawsuit to recover for that negligence," McAdams explains. "Under current state law that only applies to a spouse or parent or child who could bring that wrongful death claim." McAdams is continuing where his predecessor Sen. Scott McCoy left off and says he thinks this is in line with family values. Full Story from KSL.com

HI: Civil Union Vote Friday?

It was the most dramatic vote of last year's Legislature, and it resolved nothing: The impassioned debate at the Capitol over civil unions and gay marriage is back this week. "It is my understanding that it will be put on the Order of the Day (agenda) Thursday and put it up for a vote on Friday," said Sen. Brian Taniguchi, chairman of the Judiciary Committee. The bill was stalled in his committee with three committee members in favor and three against the bill, when it was yanked onto the Senate floor last year. It was high political drama because the bill to legalize civil unions between same-sex partners had already passed the House. Just 13 yes votes and the historic measure would go to Gov. Linda Lingle. But the Senate blinked, amending the bill and promising to come back and try again. That time is this session. Full Story from the Star Bulletin

HI: Legislature to Vote on Civil Unions Bill Shortly

When Hawaii legislators reconvene on Wednesday, all eyes will be focused not on teacher furloughs that resulted in the nation's shortest school year or the state's $1 billion budget deficit, but legislation that would allow same-sex couples to form civil unions. The measure would grant gay couples the rights and benefits the state provides to married couples and is among a handful of similar proposals that could pop up in several other states. At the same time, a federal judge in San Francisco is considering the constitutionality of California's same-sex marriage ban. "This bill has already been voted on, so there isn't as much convincing to do anymore," said Alan Spector of Equality Hawaii, a leading supporter of the bill. "I think (legislators) get the substance of the bill and the need for the bill." Last year, the proposal easily won preliminary passage in the Legislature, but stalled in May after opponents lobbied and held a state Capitol rally attended by several thousand protesters. NJ: What really Happened to the Gay Marriage Bill

New Jersey’s fight over gay marriage was cast as a debate over civil rights and a new chapter in America’s culture wars. But Thursday’s state Senate defeat of the controversial bill, considered a "slam dunk" to pass just a few months ago, also was a simple case of what happens in the bare-knuckle world of New Jersey politics. Supporters and opponents said everything changed when Gov. Jon Corzine lost to Republican Chris Christie on Election Day. "A chilling effect," said Assembly Speaker Joe Roberts (D-Camden). What happened on the way to Thursday’s vote is also a tale of turnabout in a Legislature where personality conflicts, political intrigue and religious beliefs trumped what advocates called a "vote of conscience." Uganda: President Urges Removal of Death Penalty Provision from Anti Gay Bill

Gay Ugandans likely won't face the death penalty after the president said he opposed the provision in proposed legislation, but an international gay rights group said Thursday even a watered-down bill would be repressive. President Yoweri Museveni has told colleagues he believes the bill is too harsh and has encouraged his ruling National Resistance Movement Party to overturn the death sentence provision, which would apply to sexually active gays living with HIV or in cases of same-sex rape according to a copy of the draft law. The proposed bill, though, says anyone convicted of a homosexual act - which includes touching someone of the same sex with the intent of committing a homosexual act - would face life imprisonment. It is unclear whether Museveni supports that provision or not. Gay rights activists say the bill, introduced in the fall of 2009, promotes hatred and could set back efforts to combat HIV/AIDS in the conservative East African country. Protests already have been held in London, New York and Washington. Full Story from WRAL.com: http://www.wral.com/news/national_world/world/story/6757695/

NJ: Final Effort for Gay Marriage Vote

Gay-rights advocates in New Jersey made what could be a last-ditch push yesterday to persuade lawmakers to legalize gay marriage quickly. At a time when lawmakers are calling the issue a matter of conscience, activists have been pushing the idea that some religious leaders are accepting of same-sex marriage. "It's not about religion," said the Rev. Joseph Harmon, pastor of the Episcopal Church of the Incarnation in Jersey City. "People who won't want to do it for religion reasons don't have to." A group of about 150 clergy of various faiths sent lawmakers a letter making a similar argument and asking them to support gay marriage. Mexico: Mayor of Mexico City Will Not Veto Gay Marriage Law

The mayor of Mexico City has refused to veto the bill introducing gay marriage, the Informador reported. The law, which was approved on 21 December, has suffered consistent criticism, with opponents urging Mayor Marcelo Ebrard of the progressive Democratic Revolution Party (PRD) to exercise his mayoral right to veto. The Roman Catholic archbishop of Mexico, Cardinal Noberto Rivera Carrera, deemed the bill “immoral” and “reprehensible.” Ebrard, however, has refused to overturn the new rules, which include specific rights for gays to adopt and are scheduled to take effect in March. Alejandro Rojas, the city's tourism secretary said: “Mexico City will become a center, where people from all over the world will be able to come and have their wedding, and then spend their honeymoon here". RI: Legislature May Override Governor's Veto of Funeral Rights Bill

Rhode Island lawmakers will try to override the governor’s veto of legislation allowing same-sex couples to plan the funerals of their partners. The bill received near-unanimous support from both chambers this year. But it was vetoed by Republican Gov. Don Carcieri, who said it represented an erosion of the principles behind heterosexual marriage. The governor said rights for domestic partners should be decided by voters, not by the General Assembly. The bill is among those scheduled to be dealt with before the House and Senate start their new sessions on Tuesday. NJ: Assembly Speaker Refuses to Take Up Gay Marriage Bill Again

In a setback for same-sex marriage in New Jersey, a bill to legalize it will not get an Assembly hearing on Monday. WNYC's Bob Hennelly has this update. REPORTER: In a statement released on New Year's Eve, outgoing Assembly Speaker Joe Roberts said the marathon public hearing on the bill, held in early December by the Senate Judiciary Committee, was sufficient. That committee narrowly approved the marriage equality measure. Roberts did say that if the full Senate passes the controversial bill, he'll allow an up-or-down vote on it by the full Assembly before the end of the current session. That's when Governor Corzine leaves office, and he's pledged to sign the bill. Full Story from WNYC: http://www.wnyc.org/news/articles/147371

US: Proposed Immigration Reform Leaves Out Same Sex Couples

Some gay rights advocates are upset with a Chicago congressman who's trying to spearhead an overhaul of the nation's immigration laws. Congressman Luis Gutierrez says he supports a proposal to allow lawful U.S. residents to sponsor the immigration of a same-sex partner. GUTIERREZ: If you're gay and you're married, if you're a man and man or a woman and a woman, I think the government should recognize that marriage. But a sweeping immigration bill that Gutiérrez unveiled this month leaves same-sex families out. A statement from the congressman's office says he does remain committed to ending discrimination against gay immigrants. NJ: Gay Marriage Bill Dead?

Legislation that would grant gays and lesbians the right to marry in New Jersey appears dead. It’s a question of arithmetic. At least four of the state Senate’s 23 Democrats are expected to vote against the legislation, leaving it two shy of the 21 votes needed to get it through the Senate. That means two Republican votes are needed for the Freedom of Religion and Equality in Civil Marriage Act to pass. It has to pass both houses of the Legislature — it appears to have the votes in the Assembly — and get to Gov. Jon Corzine’s desk before his successor, Christopher Christie, takes office on Jan. 19. Mr. Christie has said he will veto the legislation. State Sen. Bill Baroni, a Hamilton Republican who represents parts of Mercer and Middlesex counties, voted in favor of the bill in the Senate Judiciary Committee and will do so again if the bill ever makes it to the Senate floor. Expectations were that at least one moderate Republican — one of the five others who backed the state’s civil unions bill — would join Sen. Baroni on the right side of history. GOP: It's OK to be Manhattan Declaration Anti Gay, Just Not Ugandan Death Bill Anti Gay

As reports emerge that Uganda's president has promised to veto the "kill the gays" bill, five GOP Congressman have spoken out against the legistlation: "Five Republican representatives – Chris Smith, Frank Wolf, Joe Pitts, Trent Franks and Anh 'Joseph' Cao – have written a letter to Ugandan President Yoweri Mouseveni pressing him to stop pending legislation that would severely criminalize homosexuality and sometimes impose the death penalty for homosexual acts. In the letter, which you can read in full here, the men say their religious faith requires them to oppose the legislation because it contradicts the 'foundational Christian belief in the inherent dignity and worth of all men and women.'" The letter invokes the anti-gay Manhattan Declaration: "As Members of Congress and as men of faith, we support the principles set forth in the declaration and are thankful for the principled position of these faith leaders on a host of issues, from the sanctity of life for the unborn and others, to religious freedom, to human dignity, to the belief that marriage is an institution between one man and one woman." NM: Lawmaker to File Gay Marriage Ban Bill

After the dramatic February defeat of a proposed domestic partnership bill, a New Mexico senator is sponsoring a bill that would ban gay marriage in the state, the New Mexico Independent reported. Senator William Sharer, a Republican from Farmington, has pre-filed legislation that would define marriage as a heterosexual union in the New Mexico Constitution. The bill proposes adding the following text to the constitution: “Marriage in this state shall consist only of the union of one man and one woman.” Voter approval is needed to alter the state's constitution. Similar attempts in the last two sessions of the Legislature have died in committee. Full Story from On Top Magazine: http://www.ontopmag.com/article.aspx?id=5030&MediaType=1&Category=26
