Two American lawyers famed for the world-altering court battle that saw George W. Bush become president are together again – this time on the same side – arguing a case that could determine the future of same-sex marriage in the United States. But the San Francisco trial that began Monday is sparking a curious mix of hope and fear among advocates of gay marriage, many of whom worry the strategy to drive aggressively toward a U.S. Supreme Court ruling is premature and might ultimately backfire, setting their cause back years.
The case targets the constitutionality of California's Proposition 8, a controversial referendum that passed narrowly in 2008. In the same ballot that saw President Barack Obama win office, California voters also barred gay marriage, handing conservatives a rare and powerful victory in a state long associated with arrow-tip liberalism.
The vote left confusion in its wake, including uncertain status for some 18,000 same-sex Californian couples already wed who, in a subsequent court ruling, were told they can divorce, but not remarry.
